Terms and Conditions of Sale

These Terms and Conditions of Sale ("Terms") govern the sale of digital guides ("Products") on the website www.artsceneabroad.com ("the Site"), operated by Virginie PISLOT / ART SCENE ABROAD ("we", "us", "the Seller"). By placing an order on the Site, you ("the Customer") accept these Terms in full.

1. Products

The Products sold on the Site are digital guides provided as online, read-only content. Products are not downloadable files: they are accessible exclusively through your personal account on the Site, via streaming/online reading. No file (PDF, ePub, or other format) is sent or made available for download.

2. Prices

Prices are displayed in EUR and include VAT at the applicable Spanish rate of 21%, unless otherwise stated. We reserve the right to modify our prices at any time; the price applicable to an order is the price displayed at the time the order is placed.

3. Customer Account

Access to the Products requires the creation of a personal customer account on the Site. You agree to provide accurate, complete, and up-to-date information when creating your account, and to keep your login credentials confidential. You are responsible for all activity carried out through your account.

4. Order Process

  1. Select the desired Product(s) and add them to your cart.

  2. Review your order and provide the required billing information.

  3. Proceed to payment.

  4. Once payment is confirmed, access to the Product is granted immediately and automatically through your customer account.

An order confirmation will be sent to the email address associated with your account.

5. Payment

Payment is made online, at the time of ordering, via the secure payment methods available on the Site (managed by our payment service provider). Your order is only confirmed once payment has been successfully processed.

6. Access to Products

Once purchased, access to a Product is permanent (lifetime access) through your customer account, for as long as the Site and your account remain active. Access is strictly personal, non-transferable, and granted for your own private use only.

You are not permitted to reproduce, download, extract, copy, screen-record, redistribute, resell, or otherwise share the content of any Product, in whole or in part, without our prior written consent. Any breach of this provision may result in immediate suspension of your account without refund.

7. Right of Withdrawal

In accordance with Article 103(m) of the Spanish Consolidated Text of the General Law for the Defence of Consumers and Users (Royal Legislative Decree 1/2007, TRLGDCU) and Article 16(m) of EU Directive 2011/83/EU, the right of withdrawal does not apply to the supply of digital content not delivered on a tangible medium once performance has begun, provided that:

  • you have given your prior express consent for access to begin immediately upon purchase, and

  • you have acknowledged that you thereby lose your right of withdrawal.

By completing your purchase, you expressly agree to immediate access to the Product and acknowledge the loss of your right of withdrawal accordingly.

8. Refunds

Given the nature of the Products (digital content with immediate access), all sales are final and no refund will be issued once access has been granted, except as required by applicable law.
Refund requests may be considered on a case-by-case basis within 14 days of purchase, provided access to the Product has not been substantially used. Please contact artprojectsmallorca[at]gmail[dot]com to submit a request.

This does not affect any statutory rights you may have under applicable Spanish or EU consumer protection law, including in cases of non-conforming or defective Products.

9. Intellectual Property

All Products and their content (text, images, graphics, and any other elements) are protected by copyright and remain the exclusive property of Virginie PISLOT / ART SCENE ABROAD. Purchasing a Product grants you a limited, personal, non-exclusive, non-transferable right to access and read the content online; it does not transfer any ownership or intellectual property rights.

11. Liability

We strive to ensure that Products are accessible and accurate at all times. We cannot, however, guarantee uninterrupted access to the Site and shall not be held liable for any temporary unavailability due to maintenance, technical issues, or causes beyond our reasonable control. Our liability shall not exceed the amount actually paid by the Customer for the Product concerned.

12. Data Protection

Personal data collected during the ordering process is processed in accordance with our Privacy Policy (link to privacy policy) and applicable data protection law (GDPR and Spanish Organic Law 3/2018, LOPDGDD).

13. Governing Law and Disputes

These Terms are governed by Spanish law, in particular Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE) and the Consolidated Text of the General Law for the Defence of Consumers and Users (Royal Legislative Decree 1/2007, TRLGDCU). In the event of a dispute, and following an attempt at amicable resolution, the courts of [city/province, Spain] shall have jurisdiction, without prejudice to any mandatory consumer protection rules that may apply based on your place of residence.

In accordance with EU Regulation No. 524/2013, consumers residing in the European Union may also submit a complaint through the European Online Dispute Resolution (ODR) platform: ec.europa.eu/consumers/odr.
